JAMES W. KERR,

a witness called and sworn on behalf of the People, was examined in chief by Mr. Walker, and testified as follows:

Q Where were you on the night of May 4th?

A I was at the riot.

Q At the Haymarket?

A Yes sir.

Q In whose Company and in which rank?

A I was No. 1. in the third rank, on the east side of the street.

Q You were in Quinn's Company?

A No sir, Lieut. Steele's

Q In the third set of fours, in the rear rank, No. 1?

A Yes sir.

Q And who stood to your right?

A Officer Cook.

Q Before the bomb was exploded, did you have anything shining in your hand, either club or revolver?

A I did not

Q Did you see any one else there have a club or revolver or anything shining in their hands, any other officer?

A No sir, I did not.

MR. GRINNELL: If the Court please; We expect this closes out case. I have received a letter this noon from two witnesses from Fernwood, in the southern part of the country, and I may put them on in the morning. If we do not I will close the testimony, at which time Mr. Walker will proceed to open the case for the State. It is now four o'clock, and we can gain no time by starting with the argument now.

Whereupon Court adjourned to 10 o'clock, August 11, A.D.1886
