a witness called and sworn on behalf of the defendants, was examined by Mr. Zeisler and testified as follows:

Q What is your name?

A Martin Bechetl.

Q Where do you live?

A 414 Hurlbut Street.

Q What is your business?

A I am a brewer.

Q Do you know the defendant Oscar Neebe?

A Yes.

Q How long have you known him?

A Since March of this year.

Q Do you remember whether you have seen Mr. Neebe on the evening of May 3rd last?

A Yes sir.

Q Where did you see him?

A We were together at the North side Turner Hall.

Q What kind of gathering was it where you saw him--what was the occasion of your seeing him there?

A Mr. Neebe was a delegate tomthe meeting of the brewers that evening.

Q It was then a meeting of the brewers, was it?

A The brewers.

Q About what time did you see Mr. Neebe there?

A A little after eight.

Q Who was chairman of that meeting?

A I was, myself.

Q Did Mr. Neebe make any report there at that meeting?

A Yes.

Q Now, how long did that meeting last?

A An hour perhaps.

Q Did you see Mr. Neebe at that meeting all the time until it adjourned?

A Yes.

Q What did you do after the meeting had adjourned?

A We went to George Keith's saloon at the hall and drank one together.

Q You were there with Neebe then were you?

A Yes, I was

there with Neebe.

Q What did you do after that?

A We went across the street to a man that is sick that keeps a saloon across and took two or three there.

Q Who went there?

A I and Neebe and a large number of others, fifteen or sixteen.

Q Where did you go after that?

A We went on foot to Franz Hein's and took one there also.

Q Who went to Franz Hein's?

A I and Mr. Neebe and nobody else.

Q Did Mr. Neebe have a conversation with anybody there that you heard, yes or no--did he speak with anybody?

A No. He spoke with the saloon keeper.

Q Were you present and did you hear the conversation between Mr. Neebe and Mr. Hein?

A Yes.

Q I will ask you to look at the circular now shown you marked "People's Exhibit No. 2" and state whether you saw a paper like that in Mr. Neebe's hands while he was at Franz Hein's saloon?

A No.

Q Did you see any of these circulars on any of the tables in that saloon?

A No.

Q Did you see Mr. Neebe put any of these circulars or other circulars around on tables there?

A No sir.

MR. GRINNELL: If he didn't see any circular there how could he see them put around?

MR. ZEISLER: Q. I asked him whether he saw any circulars distributed there.

THE COURT: Whether this witness saw any circulars distributed while he was there is the thing you want to get at.

MR. ZEISLER: Exactly.

THE COURT: Let him tell.

MR. ZEISLER: He hs already answered the question.

Q Did you see any of these circulars any where in that saloon while you and Neebe were there?

A No.

Q Did you see any of these circulars in Mr. Neebe's hand while you were there?

THE COURT: He has answered that.

MR. ZEISLER: I guess that is all.

Q Do you know Capt. Schaack?

A Yes.

Q Do you know Lowenstein, this officer here?

A I don't believe so.

Q Did you see him and Capt. Schaak at the Chicago Avenue station on June 2nd last?

A Yes, I was there.

Q Did Capt. Schaack in the presence of officer Stift and officer Lowenstein on the 2nd day of June, 1886 at the Chicago Ave. station ask you if you were at Franz Hein's saloon on May 3rd?

A Yes.

Q Did you see the circulars the copy of which has been

shown you here distributed at the brewers meeting that night?

MR. GRINNELL: Neebe was there.

MR. Zeisler: That don't make any difference.

THE COURT: That is not cross examination. The brewer's meeting was not at this saloon.

MR. GRINNELL: Q. Did you see that circular with Neebe at the Brewer's meeting?

A No.

Q Did you hear Neebe speak about the police killing the people at McCormick's factory on Monday May 3rd, at the brewer's meeting.

Q Where was the brewer's meeting?

A The north side turner hall.

Q How far was that from Franz Hein's place?

A Six or seven blocks.

THE COURT: Everything that happened there is part of the meeting. Everything that was perceptible at the brewer's meeting is admissible.

MR. GRINNELL: Did you see that circular or one like it at the brewer's meeting (shows witness revenge circular)

A There was some circulars at the brewer's meeting but I don't know whether this is the one or the other.

Q Was it one like this--didn't you see a circular at the brewer's meeting entitled "Revenge "Workingmen to arms".

A No, I did not mind about that.

Q Did you not tell Capt. Schaack in the presence of officer Lowenstein and Stift on the 2nd day of June at Chicago Ave. station that you saw a circular the copy of which was shown you then, a copy of this, at the meeting at the brewer's meeting, and that the circular called for revenge and to arms, did you not tell Capt. Schaack that you saw a circular saying "Revenge" and calling to arms?

Objected to on the ground that it was brought out on cross examination and not examination in chief.

THE COURT: That is not a matter they brought out in chief.

MR. GRINNELL: Q. Did you hear Neebe speak at the brewers meeting?

A I heard him make a speech about matters concerning us as brewers as a delegate to the brewery bosses.

Q Did he not say at the brewers' meeting that night that the police, did not he speak about the police killing the people at McCormick's factory that afternoon, Monday afternoon, May 3rd?

A That I can't assert. I didn't pay any attention to that at all.

Q Did you not tell Capt. Schaack and Lowenstein?

Q I will ask him if he did not on the second day of June tell Capt. Schaack that Neebe said at the brewer's meeting that the police had been killing people at McCormick's that afternoon?

MR. GRINNELL: That is all.
