THE COURT:? I CAN REMEMBER THOMPSON'S TESTIMONY IN REGARD TO SCHWAB.
MR. ZEISLER: GILMER SEEN HIM QUARTER PAST 10 OR TEN O'CLOCK.
MR. HEINEMANN SAW HIM QUARTER PAST EIGHT, BUT MR. GILMER SEEN HIM AT 10 O'CLOCK, AND WAS SURE ABOUT THAT.
MR. INGHAM: WHETHER HE SAW HIM OR NOT, A STATEMENT MADE TO THESE MEN IS NOT COMPETENT EVIDENCE--THE FACT THAT HE IS THERE IS COMPETENT.
THE COURT: THE HOUR WHICH GILMER FIXES IS JUST THE HOUR THAT THE BOMB EXPLODED.
MR. ZEISLER: WE WANT TO SHOW MR. SCHWAB INTENDED TO SPEAK AT A MEETING OF THE STRIKERS AT DEERING'S HARVESTER WORKS, AND THAT HE DID NOT LEAVE THERE UNTIL 20 MINUTES AFTER TEN.
THE COURT: THAT IS THE PLACE TO--888 CLYBOURNE AVENUE.
MR. ZEISLER: 15 MINUTES PAST NINE.
THE COURT: THAT IS MIDWAY BETWEEN THE TIMES AT WHICH THESE TWO WITNESSES HAVE SPOKEN. AND THE FIRST TIME HE WOULD HAVE TIME TO GO FROM THE HAYMARKET, AND THE LAST TIME, HE WOULD HAVE HAD TIME TO GET BACK TO THE HAYMARKET.
MR. INGHAM: ONE OF THOSE WITNESSES HAS SWORN HE SAW THESE MEN AT 10 O'CLOCK; GILMER DIDN'T SWEAR TO ANYTHING OF THE SORT.
THE COURT: IF THE WITNESS DID NOT MENTION ANY PARTICULAR HOUR WHICH HE SAW THEM AT THE HAYMARKET, THEN THIS TESTIMONY WILL BE UTTERLY IMMATERIAL, BECAUSE YOU SAY YOU DON'T DISPUTE THE FACT THAT HE WAS THERE.
MR. ZEISLER: THAT IS TO SAY WE DON'T ADMIT ANYTHING, BUT WE WILL SHOW MR. SCHWAB'S WHEREABOUT ON THAT EVENING.
THE COURT: OF NONE OF THE WITNESSES ON THE PART OF THE PROSECUTION FIX THE TIME AT WHICH HE WAS PRESENT, BUT ONLY SPOKE OF HIS BEING THERE DURING THE EVENING, THEN THIS TESTIMONY IS IMMATERIAL.
MR. ZEISLER: MR. THOMPSON HAS SWORN THAT HE NOT ONLY SAW MR. THOMPSON AND MR. SPIES AT THE ALLEY, WHERE THEY TALKED ABOUT THE NUMBER OF BOMBS WHICH SHOULD BE BROUGHT TO THE OFFICE, BUT HE SAW THEM GO TOGETHER ON RANDOLP STREET, AND COME BACK, AND THAT WAS AFTER HALF PAST EIGHT AT THE TIME MR. SCHWAB LEFT THERE.
THE COURT: I DON'T SUPPOSE THAT IS COMPETENT.
