OFFICER WEINECKE,
recalled for further cross examination, was examined by Mr. Zeisler and testified as follows;
Q How long have you been on the police force of Chicago?
A Since the 20th April.
Q In what part of the head did the bullet enter?
A Here (witness designates with his hand back of the right ear).
Q Where did it come out, or was it taken out?
A No, it ain't out yet.
Q What was its direction-- tell if you know which direction it went?
A What direction from the man where it came from.
THE COURT: Q Tell us where it went in, and where it is now so far as you know?
A It went in there, and went down there-that is what the doctor claims.
Mr. Zeisler: Q Did you say to anybody that you received that show from a brother officer?
Mr. GRINELL: Is it for the purpose of impeachment?
Mr. ZEISLER: Yes sir.
Mr. GRINELL: Designate the officer. He may have said it to five or six men.
THE COURT: Did he testify on his dircet from what source the pistol shot came?
Mr. GRINELL: Nothing whatever. It is not proper cross examination. He simply testified that he was shot, but who shot him he didn't give any account of. They can call him on their part of the case to prove where it came from.
Mr. ZEISLER: We want to test the varacity of this witness and want him to give answers to the questions now, and want to show by other witnesses that he told a different story.
THE COURT: He has merely testified to the fact thathe was wounded but from what source the shot came he gave no account. Then any account that he has given out of doors as to where it came from is in no manner inconsistent with any testimony here because he has given no testimony on that subject.
Mr. ZEISLER: Q I will ask you where you stood at the time you received that bullet?
Objected to.
Q In what rank were you?
A I was in the first company Lieut. Steele's.
Q First rank, front rank"
A Yes sir.
