FRED P. ROSBACK,

a witness produced on behalf of the People, after having been duly sworn, testified as follows:

DIRECT EXAMINATION
By Mr. Grinnell.

Q What is your business?

A Machinist.

Q Where is your place of business?

A 224 East Washington Street.

Q Do you know Rudolph Schnaubelt?

A Yes.

Q Did he work for you?

A Yes.

Q Do you remember the night of the throwing of the bomb?

A Yes.

Q Did he work on the Tuesday prior to that -- the day on which the bomb was thrown?

A No, sir.

Q When did you see him before that Tuesday?

A On Monday.

Q On Monday did he say anything to you about coming back Tuesday, or wanting to leave business?

A No, sir.

Q Did you see him on Tuesday?

A Yes.

Q Did he say anything then about wanting to get away?

A He said that he could not be here today, that he had other business.

Q On Tuesday when you saw him did he have a beard on.

A Yes.

Q When did you next see him?

A I next saw him Wednesday morning.

Q At what hour?

A He came to work at seven o'clock.

Q Did he work that day?

Objected to as being an occurrence after the throwing of the bomb; question withdrawn.

Q Did he have a beard on that day?

Objected to.

Mr. GRINNELL: It is for the purpose of identification.

Objection overruled, to which ruling of the Court defendants by their counsel then and there duly excepted.

Q Did he have a beard on on Wednesday?

A Yes.

Q Did you see him Thursday?

A Yes.

Q Did he have a beard on then?

Objected to; objection overruled; to which ruling of the Court defendants by their counsel then and there duly excepted.

A Thursday morning he had his beard shaved off.

Q Did he have a moustache on?

A He had a moustache, but it was clipped off.

Q Have you seen him since?

A I saw him Friday.

Q Where?

a At the shop, he came to work Friday morning.

Q Did he work that day?

A He worked until he was arrested by a detective and taken away.

Q What hour in the day was that?

A It was probably

ten o'clock.

Q Have you seen him since?

A He came back in about an hour and went to work again.

Q How long did he stay?

A Until night.

Q Since then have you seen him -- the night of Friday?

Objected to; objection sustained.

On motion of counsel for defendants the testimony from the question "Have you seen him since" down to this point, of this witness, is ordered stricken out.

CROSS EXAMINATION
By Mr. Foster.

Q The bomb was thrown, you understand, Tuesday night?

A Yes.

Q He had a beard on Tuesday?

A Yes.

Q And on Wednesday, the following day?

A Yes.

Mr. GRINNELL (Handing photograph to witness) Who is that a photograph of?

A That is a photograph of Rudolph Schnaubelt.

Q The man that you were talking about a moment ago?

A Yes.
