re-called by the defendants, was examined by Mr. Foster and testified as follows:

Q- I will ask you whether at any time during your speech, at about the time the police were approaching, or at anytime you made use of these words, or of any words of similar or like import "There come the blood hounds, now you do your duty and I'll do mine."

MR. GRINNELL: You asked him that.

THE WITNESS: I said no-- You asked me last night.

Q- I will ask you whether you were present before the coroners jury at the time the investigation of the death of Degan was taking place?

A- Yes sir.

Q- Were you then under arrest?

A- Yes sir.

Q- And you were present?

A- Yes sir.

Q- Where was that inquest held?

A- It was held in the

court house--- I could not tell you which room. It was held up several flights of stairs. If I remember rightly they did not take it to the court house.

Q- You were in custody at the central station, and you were not taken out doors?

A- No.

Q- Did you hear the testimony of policemen and others who testified there?

A- Yes.

Q- Now, I will ask you if in that testimony from the beginning to the end, whether there was a word said about your having fired a pistol shot?

Q- When did you first learn it was claimed you fired a pistol shot?

MR. FOSTER: WE offer to, prove that witnesses tstified in the hearing of other witnesses and in the presence of the defendant Fielden and not one word was said about his firing a pistol, shot, and that he never heard of it until he read it in a newspaper several weeks afterwards, that there was a claim of that character, about the time the grand jury were investigating it.

THE WITNESS: There was not anything said about the blood hounds either?

MR. INGHAM; Wait a minute.
