OFFICER WESSLER re-called.

Mr. Black: Q You have already stated that none of the defendants now on trial were present at the Desplaines Street Police Station when you gave your testimony there?

A Not as I know of.

Q I want to ask you whether as a matter of fact you did not pick out one of the defendants who was then and there on trial, and state that you believed that that was the man who fired from behind the wagon?

A No sir.

Q You did not?

A I did not.

Q Wasn't there there a smooth face black haired man, black-eyed, who stated that he was a blacksmith and worked for Bettner whom you picked out and said that he was the man who fired?

A No sir.

Q You are certain of that?

A Yes sir.

Mr. GRINNELL: Q Do you remember at that examination of picking out from the crowd around of somebody that was there, a boy that was in proximity to the revolver when it was found?

A Yes.
